Practice Areas
Attorney Tara Lynn Witt has fought to protect her client's constitutional rights and legal interests for more
than 16 years. She understands how an accusation or disputed legal matter can cause detrimental ripple effects
throughout someone's life, which is why her practice focuses first on each client's unique personality and
factual situation to inform the most robust possible legal strategy both in and out of the courtroom.
Criminal Defense
As a trial-level public defender, Attorney Witt handled thousands of cases ranging from less serious traffic offenses to aggravated felonies carrying the most serious penalties available under the law. Her caseload included offenses for driving while intoxicated, theft, drugs, weapons, arson, assaults and sexual violence, domestic violence, and murder, By showing the humanity in the individual defendant, separately from the State's criminal accusation, she has been successful in reaching positive outcomes for her clients.
Appeals
After moving to Texas, Attorney Witt joined a post-conviction office that reviews and files appropriate appellate challenges on behalf of death-sentenced individuals. In that work, Attorney Witt used the foundation built over years of trial practice to approach each case with a keen eye toward identifying the strongest issues to challenge on appeal. Attorney Witt is skilled in using clear and persuasive writing, in addition to well-reasoned arguments in court, to show why her client deserves to win the appeal.
Mental Health and Drug Addiction
Mental health issues and drug addiction can wreak havoc in an individual's life. Unfortunately, for many, that havoc leads to interactions with the criminal justice system. Attorney Witt has represented hundreds of clients struggling as a result of their mental health and/or drug addiction. She understands that the case that brought the individual into the courtroom can sometimes be the tip of an iceberg, and the critical importance of finding the right path forward that best meets that individual's specific needs. Veterans Accused in Civilian Courts

While with the New Hampshire Public Defender, it was Attorney Witt's honor to serve as one of the defense attorneys on the treatment team for the Rockingham County Veteran's Court. Through those client representations, she gained insight into many unique issues facing our nation's veteran population and found creative ways forward that often avoided criminal consequences while still addressing the underlying issues.
Litigation and Jury Selection
Current and former public defenders and prosecutors are lucky to spend more time advocating in courtrooms than many of their civil law counterparts. Yet the oral advocacy skills used in criminal trials and those used in other types of contested hearings are interchangeable. Over the past 16 years, Attorney Witt has fought contested hearings and trials before judges or juries well over 100 times. With her thorough voir dire preparation and questioning, she can identify the individuals who are open to hearing her client's truth and finding in their favor. She understands that argument phrasing matters depending on her audience. Attorney Witt is prepared to put all of that knowledge to work on your behalf and fight for the best outcome in your legal dispute.
